JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending her arrest in connection with Rajpur P.S. Case No. 229 of 2013 registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471 and 379 of the Indian Penal Code, seeks the privilege of pre-arrest bail. Allegedly, from the house of the petitioner being Pramukh of Chausa Prakhand, several objectionable documents relating to MGNREGA and pass books were recovered and on that basis, the petitioner and Panchayat Rojgar Sewak have been made accused.

Submission is of false implication and that due to political rivalry, the case has been lodged. The Panchayat Rojgar

Patna High Court Cr.Misc. No.30334 of 2014 (2) dt.22-01-2015 Sewak, Amrendra Kumar Pandey @ Amrnadra Kumar Pandey has been allowed pre-arrest bail by another Bench of this Court vide Cr. Misc. No. 22945 of 2014 by order dated 08.09.2014 and against the petitioner, there is no specific allegation for committing any forgery or misappropriating the government amount and she is involved in two cases wherein one case, she has been allowed bail.

Considering the facts and circumstances of the case, the petitioner, in the event of her arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 229 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P.C. (Jitendra Mohan Sharma, J.) Vats/- U T
