JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 The petitioner is apprehending his arrest in connection with Patna Mahila P.S. Case No. 10 of 2014 for the offences instituted under Sections 498(A), 379/34 of the I.P.C. and 3⁄4 of the D.P. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that in the month of November, 2013, the informant alongwith her husband came from Bangalore to Patna to celebrate Diwali and she was asked by her father-in-law about the current position of her account that how much money is in her account. On refusal that she does not have any money in her account, she was told by her Bhaisur Abhishek
Patna High Court Cr.Misc. No.24293 of 2015 (2) dt.13-07-2015 2/3 Kumar, Gotani Shilpi Kumari and father-in-law Kedar Rai to bring a four wheeler and rupees ten lacs from her father. Further it has been alleged by the informant that after that behaviour of her in-laws and others changed and all of them tortured her. Her father-in-law and her husband(petitioner) opened a joint account in Central Bank of India and asked her to deposit rupees ten lacs in that account otherwise she will have to face the consequences. Again she went to Bangalore alongwith her husband where she joined her job in Microsoft Company and alleged that when she returned from office she was beaten by her husband and father-inlaw.
One day she was told by them that they are giving her last chance for fulfilment of their demand and if she does not pay then she will be married to another girl. Further it has been alleged that on 01.03.2014 her husband and father-in-law told her to prepare tea for them and when she went to kitchen and then she saw that gas was leaking but they forced her(informant) to go to kitchen. Anyhow she raised alarm and rescued by society people. Her cousin brother came and she started living in Girls Hostel at Bangalore on 20.03.2014, she alongwith her father went to Patna, the dispute to settle but as soon as she reached there she was beaten by her husband, father-in-law and great grandfather (Nana).
Patna High Court Cr.Misc. No.24293 of 2015 (2) dt.13-07-2015 3/3 to Mahila Police Station where a bond was signed by her and her husband but demand of dowry is still continued. It has been submitted on behalf of the petitioner that the petitioner is the father-in-law of the informant. It is further submitted that the petitioner has no concern with the husband of the complainant.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Patna Mahila P.S. Case No. 10 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
