The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 192 bottles of royal stag (each containing 750 ml.), 360 bottles of imperial blue (each containing 750 ml.) and 816 bottles of kingfisher (each containing 500 ml.) were recovered from a vehicle. It is further contended that petitioner was not arrested from the spot and he has been implicated in this case in view of the fact that he is owner of the aforesaid vehicle. It is urged that driver of the aforesaid vehicle has already been granted bail vide order dated

Patna High Court Cr.Misc. No.39006 of 2017(2) dt.19-08-2017 2/2 10.08.2017 passed in Criminal Miscellaneous No. 36178 of 2017. Petitioner claims that he is having clean antecedent and is in custody since 13.06.2017.

Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Excise Act, Katihar in connection with Balrampur P.S. Case No. 78/2017.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
