ANJANA MISHRA ORAL ORDER 16-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner being the husband is apprehending his arrest in connection with Konch P.S. Case No.26 of 2015 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

Case diary along with postmortem report in the present case was called for, which has since been received. Learned counsel for the petitioner submits that compromise has now been taken place but on consideration of the case diary and the other materials which has been placed before this Court, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, rejected.

Patna High Court Cr.Misc. No.20517 of 2016 (4) dt.16-11-2016 2/2 If, however, the petitioner surrenders in the court below, the court below shall consider this case on its own merit without being prejudiced by this order.
