JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 376(d), 313, 386, 120(B), 115 of the Indian Penal Code. The informant has alleged in the F.I.R. that one year before while she was coming from coaching, she got thirsty and went to the shop of Bholu Singh to drink cold-drink. Thereafter the petitioner gave her cold-drink and she became senseless. When he became conscious, she found herself on the roof of shop of the petitioner. The accused persons including the petitioner made obscene video of the informant. They made physical relation with her. After some time, they send the video on her mobile and asked her to give Rs.10,000/-, they threatened to viral the video. She got scared and gave said amount to the accused persons. The accused persons continuously asked her to give money.
Patna High Court CR. MISC. No.15355 of 2019(5) dt.24-07-2019 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 7.9.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. It has come in course of investigation that there was love affairs between the petitioner and the victim. Other co-accused has been granted bail vide Cr.Misc.No.78465 of 2018.
On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Arah in connection with Bhojpur Mahila P.S. case No.118 of 2018.
