JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered under Sections 147, 148, 448, 341, 323, 149, 324, 325, 307, 302, 427 of the Indian Penal Code and 27 of Arms Act.

Allegation against the petitioners and other accused persons is of assaulting the informant and others. Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. It is further submitted that there is no specific allegation of assault against the petitioners and they remained in custody since 12.07.2017.

Heard learned A.P.P. also, who opposed the prayer of

Patna High Court Cr.Misc. No.40068 of 2017 (2) dt.24-08-2017 2/2 bail on the ground that this case relates to the honour killing and the petitioners and other accused persons have participated in the occurrence and the girl is still traceless. It is further submitted that similarly situated co-accused, namely, Ganesh Yadav, has been granted bail by this Court vide order dated 19.08.2017 passed in Cr. Misc. No. 37206 of 2017.

Having considered the facts and circumstances of the case, as stated above, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur in connection with Kajraili P.S.Case No. 23 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned and further with a condition that they will co-operate in the trial and will appear in court on each and every date fixed in the case, failing which their bail bonds shall be liable to be cancelled.
