The petitioner is apprehending his arrest in connection with Ramgarhwa P.S.Case No.119 of 2018 dated 12.6.2018 , registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be mother-in-law, is of dowry death.

Submission of the learned counsel for the petitioner is that the materials collected during the course of investigation clearly discloses that the deceased has herself set on fire and no allegation has been levelled against the petitioner that she has set her on fire and as a matter of fact son of the petitioner was idiot as such she was not satisfied with him.

Patna High Court CR. MISC. No.14917 of 2019(3) dt.02-05-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the evidence has come that the petitioner is used to quarrel with the deceased and all the accused persons have set her on fire.

Having heard both sides and in view of discussion made above, let the petitioner, above named, let the petitioner surrender before the court below within a period of six weeks from the date of receipt of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Raxaul, East Champaran in connection with Ramgarhwa P.S.Case No.119 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will cooperative in the investigation and appear before the police as and when required.

With the aforesaid direction, this application is allowed.
