Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 279, 427 of the Indian Penal Code and Section 47(a)(f) of the Excise Act.
20 quintals of mahua flower kept in 50 gunny bags were recovered from a mini truck being driven by this petitioner.
It is submitted by learned counsel for the petitioner that petitioner was not aware about the articles kept in the mini truck and he was only a bona fide driver of the public carrier.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Let learned Court below consider the prayer
Patna High Court Cr.Misc. No.23889 of 2015 (2) dt.29-06-2015 2/2 for bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barari P.S. Case No. 47 of 2015, pending in the Court of learned Chief Judicial Magistrate, Katihar.
With the observations above, the application stands disposed off.
