JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 506/34 of the Indian Penal Code.

The prosecution case is that the informant has two brothers and one sister, out of them one brother and sister are mentally abraised whereas the other brother Sanjay Soni and this petitioner being the wife of Sanjay Soni started disbursing of the ancestral property without taking care of the mother of the informant and on protest being made, the husband of the informant was abused by the petitioner and her husband when petitioner and her husband and 4-5 unknown persons assaulted the husband and took away Rs. 30,000/- from his pocket.

No.23885 of 2015 (2) dt.26-06-2015 2/2 It is submitted by learned counsel for the petitioner that petitioner is the brother's wife of the informant and due to property dispute, the accusation has been levelled and considering the fact that the injury report reflects sharp cutting injury, though, accusation is of making assault by bricks, stones and iron rod, the husband of the petitioner Sanjay Soni has been granted regular bail vide Cr. Misc. No. 19728 of 2015.

Considering the fact that accusation of assault is not specific against this petitioner who is a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Begusarai Town P.S. Case No. 134 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
