Petitioner seeks bail in a case registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

The F.I.R. of the occurrence of murder is against unknown. The only material against the petitioner is confessional statement of the petitioner before the Police, which is not a relevant piece of evidence. The court below has relied on the confessional statement of the petitioner for refusal of the prayer for bail.

Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.35754 of 2018 (2) dt.27-06-2018 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Udwant Nagar Police Station Case No.167 of 2017, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
