2. The petitioner seeks bail in a case registered for the offence punishable under Sections-302, 201, 34 of the Indian Penal Code.

3. Allegedly, the nephew of the informant was murdered by the accused persons and his dead body was recovered from the Balan river.

4. It has been submitted on behalf of the petitioner that the investigating authorities did not find the case true against the petitioner and he was exonerated by the investigating authority in the year, 2011 but the learned Magistrate took cognizance against him on 19-02-2019 without any cogent

It has further been submitted that the witnesses examined during course of investigation have stated categorically that the deceased was a person of criminal nature and he has solemnized marriage with a lady belonging to the Maoist group and it was the reason of his murder.

Mr. Shailendra Kumar, learned APP although opposed the prayer for bail but fairly conceded that the independent witnesses have stated in different paragraphs of the case diary that the deceased was a person of criminal antecedent. The petitioner and two other co-accused persons have been exonerated during course of investigation.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Begusarai in connection with Birpur (Beerpur) P.S. Case No. 98 of 2010.
