The petitioner is apprehending his arrest in connection with Mairwa P.S.Casae no.472 of 2018 registered for offences punishable under Sections 420, 467, 468, 471 of the Indian Penal Code.

Prosecution case in short is that the raiding party on the instruction of the Civil Surgeon raided Sai Baba Dharmarth Chkitsalay, Sivpur Mathiya, Mairwa, Siwan, one Bandana Singh was present there and on demand of her qualification certification, she could not produce the certificate and documents and said that the same was locked in the chamber of Dr.A.K. Singh (petitioner) and the further allegation is that the documents were not produced in spite of the direction. Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.15232 of 2019(3) dt.02-05-2019 2/2 that earlier also the clinic of the petitioner was raided and on full trial, the petitioner was acquitted as the certificates were found genuine.

Heard learned A.P.P. , who has opposed the prayer for bail of the petitioner stating that the petitioner has not produced the certificate .

In such view of the matter, let the petitioner, above named, surrender before the learned court below within a period of six weeks from the date of receipt of order and on that he will be released on provisional bail for the period of three months and in the meantime, the petitioner shall produce certificates to the Investigating Officer, who will inquire about the same and once the report about the genuineness of the certificates is received to the court, he will confirm the bail bond of the petitioner, otherwise he is free to pass any other order or orders, as he deems fit and proper.
