Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 273, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Country made liquor was allegedly recovered from the house of the petitioner. Petitioner is only accused in this case.

Submission is that the petitioner has got no criminal antecedent. House is occupied by other family members also. Considering presumption under Section 32 of the Bihar Prohibition and Excise Act, 2016 and consequent bar of prayer for anticipatory bail under Section 76(2) of the said Act, I

Patna High Court CR. MISC. No.26825 of 2021(2) dt.06-12-2021 2/2 am not inclined to enlarge the petitioner on anticipatory bail in connection with Dagarua P.S. Case No. 228 of 2020 pending in the Court of learned Special Judge, Excise, Purnea/successor Court.

Accordingly, prayer for anticipatory bail is refused. Petitioner is directed to surrender within a period of two weeks and pray for regular bail.
