JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419 and 42/34 of the Indian Penal Code.

It is alleged that the petitioner and one Mohanlal persuaded the informant to invest in a non-financial company namely Unipay 2 U Marketing Pvt. Ltd. when the informant was assured that he will get double of the invested amount in ten months, consequently, the informant invested `2,10,500/- but he was not paid the maturity amount, subsequently, Mohanlal issued two cheques which got bounced.

It is submitted by learned counsel for the petitioner that the thrust of accusation is against Mohanlal. Though, the informant has realized `50,000/- from the petitioner but the

Patna High Court Cr.Misc. No.23797 of 2015 (2) dt.09-07-2015 2/2 informant has entered into compromise with the petitioner, the same has been brought on record as Annexure-3 of the petition. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the thrust of accusation against Mohanlal, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 119 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
