Earlier prayer for bail of the petitioner was rejected by order dated 28.1.2017 passed in Cr.Misc.No.54722 of 2016 with an observation to renew his prayer for bail before the court below after framing of charge.

Submission of learned counsel for the petitioner is that out of eight witnesses six have been examined and nothing has come against the petitioner in their evidence. Heard learned APP also.

Having heard both sides and in view of fact that earlier prayer for bail was rejected on merit and trial is at concluding stage, I am not inclined to grant bail to the petitioner at this stage. However, learned trial court is directed to expedite the

Patna High Court Cr.Misc. No.43204 of 2017 (2) dt.13-09-2017 2/2 trial and try to conclude it within four months. At the same time, Superintendent of Police, Kishanganj is directed to ensure the presence of witnesses in court so that trial be concluded within the specific time.
