Petitioner is in custody in connection with Barachati P.S. Case No. 20/19 for the offence under sections 30(a), 38, 47 of the Bihar Excise and Prohibition Act, 2016. Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.

In the instant case total 1500 liters of liquor was seized from a pick up van.

Learned counsel submits that the vehicle does not belong to the petitioner. He is neither owner of the vehicle nor the liquor. Nothing was recovered from the possession of the petitioner.

Petitioner is in custody since 17.01.2019.
