JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 11.01.2020, seeks bail in connection with Gaya Kotwali P.S. Case No. 574 of 2019, dated 17.12.2019, instituted for the offence under Sections 147, 148, 149, 341, 323, 427, 435, 436, 353, 290, 283, 188, 379 and 120 (B) of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage to Public Property Act, 1984. It appears that several persons have been made accused in the aforesaid case but no specific accusation has been attributed to the petitioner except for his having participated in the procession march against what

Learned counsel for the petitioner further submits that petitioner does not have criminal antecedents and similarly situated persons have been granted bail by the Court below and some of them have been granted bail by different Benches of this Court also.

Considering the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Gaya Kotwali P.S. Case No. 574 of 2019.

The application stands allowed.
