Mr.Rina Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 19-06-2019 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case registered under Sections 341, 323, 324, 325, 307, 354(B), 379, 504, 506, 34 of the Indian Penal Code.

The prosecution case in short is that the accused persons reached at the Darwaza of the informant and started asking him to withdraw the case and on refusal, the said accused persons assaulted the informant by means of Dabiya, Farsa, Tangi etc as a result of which, he sustained injuries.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.22412 of 2019(4) dt.19-06-2019 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 31-10-2018. Charge sheet has already been submitted. There is admitted land dispute between the parties. The nature of injury is said to be simple. No offence u/S 307 of the Indian Penal Code is made out. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated 01-05-2019 passed in Cr. Misc. No. 20812 of 2019. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIIth, Bettiah, West Champaran in connection with Bairiya P.S.
