2. The petitioner is in custody in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 354(B), 380, 504 and 506 of the Indian Penal Code.

3. Allegation against the petitioner is to have assaulted the son of the informant by means of iron rod and lathi.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that both the parties are neighbours and having dispute from before. Petitioner is in custody since 23.09.2025.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

On perusal of the first information report, impugned order dated 03.02.2026, injury report of the victim and the report of the learned trial Court bearing letter no.60, dated 19.05.2026, it appears that the case is pending for appearance of the remaining accused persons as also the fact that trial of this case is not likely to be concluded in near future and from perusal of the injury report of victim, namely, Indrajeet Sharma, it appears that the injury is lacerated wound of size 5"x1 cm x bone deep is seen over right parieto-temporal region and nature of injury is grievous and caused by hard and blunt object, so in view of the above facts, I am inclined to grant bail to the petitioner.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa Sadar P.S. Case No. 742 of 2023.
