The petitioner apprehends his arrest in Excise Case No.530 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The Excise officials got secret information that the petitioner kept liquor on the roof of his house and on such information, a raid was conducted. 17.175 litres of Indian made foreign liquor was recovered.

The learned counsel for the petitioner submits that petitioner is not residing in his house. He is living in Delhi to earn his livelihood. The neighbours may have kept the liquor on the roof of his house but it appears that recovery is made from the roof of the house of the petitioner on information that

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
