JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 452 and 380/34 of the Indian Penal Code and Section 3 (I) (X) (VIII) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that the accused persons including the petitioners entered into the house of the informant, tried to outrage the modesty, abused the informant by calling caste name and also
Patna High Court Cr.Misc. No.23778 of 2015 (2) dt.09-07-2015 2/2 assaulted with fist and slap. It is also alleged that petitioner no.2, Chhotu Thakur took a box containing silver ornaments. It is submitted by learned counsel for the petitioners that for the occurrence of 06.07.2014, the complaint was filed on 07.07.2014 which came to be registered as a police case on 04.02.2015 and subsequently, the informant has retracted from his initial version. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforementioned facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Buxar in connection with Buxar (SC/ST) P.S. Case No. 08 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
