JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 and 379 of the Indian Penal Code.
The petitioners alleged to have assaulted Sudhir Kumar who died on the spot.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioners. Let the learned court below consider the prayer for
Patna High Court Cr.Misc. No.23799 of 2015 (2) dt.09-07-2015 2/2 regular bail of the petitioners if they surrender within a period of six weeks in connection with Salimpur P.S. Case No. 07 of 2014 pending in the court of learned JM, 1st Class, Barh, Patna keeping in view that as submitted, other similarly situated accused persons has been granted regular bail.
Accordingly, the application is disposed of.
