The petitioners are in custody in connection with Masaurhi P.S. Case No.265 of 2017, a case under Sections 302/201/34 of the Indian Penal Code but charge sheet has been submitted under Sections 304/201/34 of the Indian Penal Code. There is no eyewitness of the occurrence of murder. Annexure-2 reveals that after going through the case-diary and finding no substantial material co-accused Pappu Kumar was allowed bail by a coordinate Bench of this Court in Cr. Misc. No.680 of 2018.
Hence, let the petitioners, above named, be
Patna High Court Cr.Misc. No.36511 of 2018 (2) dt.03-07-2018 P2/ released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Masaurhi Police Station Case No. 265 of 2017, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (Birendra Kumar, J) Mkr./- U T
