The petitioners, in the present case, are seeking regular bail in connection with Kotwali P.S. Case No.283 of 2018, registered for offences alleged under Section 420 and 379/34 of the Indian Penal Code.
It is submitted on behalf of the petitioners that the petitioner no. 1 is the mother who happened to be an Assistant Teacher in Government High School whereas the petitioner no. 2 is her unmarried daughter. As per the allegations in the F.I.R., the petitioners had committed theft of a "Neelam Stone" from the jewelry shop worth Rs. 1,10,500/-. Learned counsel submits that the petitioners are in custody since 10.05.2018, the petitioner no. 1
Patna High Court Cr.Misc. No.34556 of 2018 (2) dt.14-06-2018 has already been suspended from service whereas the petitioner no. 2 being unmarried daughter and both of them having no criminal antecedent their case may be considered for grant of regular bail.
Learned APP for the State is present.
Considering the facts and circumstances of the case particularly that the petitioners have no criminal history, the petitioner no. 1 is said to be a Government employee and petitioner no. 2 is an unmarried daughter of petitioner no. 1, let both of them be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 283 of 2018, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
