This application is for grant of regular bail in connection with Ghosi P.S.Case No.367 of 2016 , registered for the offences punishable under Sections 25(1-B)a/26 of the Indian Penal Code.
Allegation against the petitioner, as per FIR, is about recovery of one country-made pistol and 08 cartridges from the 'Dalan' of the petitioner and Para 3 of the petition also shows that he is accused in two more cases.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his conscious possession and though he was in custody in connection with other cases also since 18.12.2016 and he has been remanded in custody in the present case since 13.7.2017.
Patna High Court Cr.Misc. No.42360 of 2017 (2) dt.12-09-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail on the basis of recovery as well as criminal antecedent of the petitioner.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned. With the aforesaid observation, this application is dismissed.
