The petitioner seeks bail in Kursakanta P.S. Case No. 155 of 2017 registered under Section 7 of the Essential Commodities Act.

As per the prosecution case, twelve jute bags of government subsidised wheat is said to have been recovered from the house of the petitioner, which is said to have been purchased by him from the PDS dealer, namely, Satya Narayan Yadav. It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from his conscious physical possession rather the same has been recovered from the house of the petitioner. Petitioner is a member of joint Hindu family and the seized articles belongs to the petitioner as

Patna High Court Cr.Misc. No.38056 of 2017 (02) dt.10-08-2017 2/2 well as other BPL card holder of his family. Petitioner has been falsely implicated in this case due to dirty village politics. The petitioner has been languishing in custody since 21.06.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Kursakanta P.S.
