JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kutumba P.S. Case No. 68 of 2018 for the offence under Section 414 of the Indian Penal Code and Sections 30(a), 38(ii) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner is in custody since 13.05.2018. Learned counsel submits that similarly circumstanced co-accused Himanshu Kumar @ Bittu Kumar has been granted bail vide order dated 29.06.2018 in Cr. Misc. No. 35522 of 2018.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.37451 of 2018 (2) dt.02-07-2018 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 68 of 2018.
