The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 504/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Petitioner is aged about 63 years. Petitioner has some matrimonial dispute with his wife opposite party No. 2. Submission is that petitioner is already paying maintenance amount of Rs. 12,00/- (Twelve Hundred) per month to his wife in a maintenance case brought by the wife

Patna High Court CR. MISC. No.15226 of 2019(2) dt.12-03-2019 2/2 opposite party No. 2, the petitioner has stated on oath in para 12 of the bail petition.

Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Complaint Case No. 336C of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
