JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2015 Since both the applications arise out of Forbesganj P. S. Case no. 303 of 2014, they have been heard together and are being disposed of by this common order.
The petitioners are apprehending their arrest in a case instituted under Sections 302/201/34 of the Indian Penal Code. Allegation against the petitioners is that they have killed the daughter of the informant.
It has been submitted on behalf of the petitioners that petitioners have got no criminal antecedents. The name of the petitioners has come merely on suspicion. There is no direct or indirect evidence against the petitioners. The other co-accused
Patna High Court Cr.Misc. No.23830 of 2015 (4) dt.16-09-2015 2 / 2 have been granted bail vide Cr. Misc. no. 45649 of 2014. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the facts and circumstances of the case, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case no. 303 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
