The petitioner seeks bail in a case instituted under Sections 379/511 of the I.P.C., 15(2), 15(4) of P.M.P. Amendment Act, 2011, 3⁄4 of Explosive Substance Act and 3⁄4 of Prevention of Damage to Public Property Act, 1984.
Allegation is that some unknown miscreants committed theft on the petrol pump by opening the valve and nipple of the main pipeline.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.4.2017. Charge sheet has been submitted in the case. There is no allegation of tampering of
Patna High Court Cr.Misc. No.43030 of 2017(2) dt.20-09-2017 2/2 witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on the basis of confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. Other co-accused has been granted bail vide Cr.Misc.No.38203 of 2017.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jhajha P.S. case No.12 of 2014.
