This is an application for bail in connection with Kurhani P.S. Case No. 34 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code.
Petitioner is not named in the FIR but his name transpires in the confessional statement of co-accused and further he has been made accused in four other cases.
Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and no Test Identification Parade was held and he is in custody for more than three months. Further submission is that so far other cases are concerned, he is on bail in those cases and co-accused has been granted bail by this Court in Cr.misc.No.35657 of 2017, vide order dated 8.8.2017.
Heard learned APP also, who has opposed the prayer for
Patna High Court Cr.Misc. No.36657 of 2017 (3) dt.04-09-2017 2/2 bail.
Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Kurhani P.S. Case No. 34 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in the local police station in first week of every month till conclusion of trial, failing which prosecution will be at liberty to move cancellation of his bail bond.
