2. The petitioner seeks regular bail in the present case registered for the offences punishable under Sections 127(2), 115(2), 109(1), 103(1) and 3(5) of the B.N.S.

3. As per the prosecution case, six named accused persons are said to have assaulted and killed the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that the informant in his restatement which was taken after two months has named the petitioner. It is next submitted that if the petitioner would have been found to have assaulted the deceased, his name would

Patna High Court CR. MISC. No.16758 of 2026(2) dt.08-05-2026 2/2 have disclosed in the FIR and not after two months. Petitioner has clean antecedent and he is in custody since 28.07.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned counsel for the informant as well as learned A.P.P. for the State have jointly opposed the prayer for regular bail of the petitioner but are unable to controvert the argument of learned counsel for the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi /concerned Court below in connection with Bathnaha P.S. Case No. 392 of 2024.
