Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 409, 420, 468, 467 and 471 of the Indian Penal Code.
The petitioner was Circle Officer at the relevant time and he had issued a cheque in the name of Ashish Enterprises of Rs.1,81,405/-. The proprietor or representative of Ashish Enterprises interpolated in the cheque and the amount was shown as Rs.21,81,405/- and, accordingly, the public money was withdrawn by Ashish Enterprises.
Submission is that on the order of the District
Patna High Court Cr.Misc. No.34641 of 2018 (2) dt.18-06-2018 2/2 Magistrate, the successor Circle Officer has lodged the F.I.R. Petitioner has no role in the interpolation of the cheque nor even allegation of any collusion with Ashish Enterprises. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gopalpur (Rangra O.P.) P.S. Case No. 214 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
