JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 406, 420, 467, 468, 504 and 120B of the IPC.
It is alleged that on assurance by the petitioner and coaccused Dilip for getting the son of the informant employed in Bokaro Still City, `2 lacs was given to the petitioner on 01.12.2012 but subsequently, co-accused Dilip gave forged appointment letter and when the informant demanded his money back then he was abused and assaulted.
It is submitted by learned counsel for the petitioner that for the occurrence of 01.01.2012, the complaint was filed on 28.01.2015 which came to be registered as a police case on 17.02.2015 and admittedly, the forged appointment letter was
Patna High Court Cr.Misc. No.23774 of 2015 (2) dt.09-07-2015 2/2 handed over by the co-accused Dilip and there is no proof with regard to payment.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Mahnar P.S. Case No. 28 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
