Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 399, 402, 414, 353, 307 of the Indian Penal Code and 25(1-B),a, 26, 27, 35 of the Arms Act.
It is alleged that Rakesh Kumar Raut, Vikash Kumar Rai and Santosh Mahto were apprehended by the police and from their possession country made pistol and nine live cartridges were recovered. They suggested the name of the petitioners as their associates.
It is submitted by the learned counsel for the petitioners that no recovery has been made from the petitioners and only on confessional statement of co-accused the present
Patna High Court Cr.Misc. No.23833 of 2015 (2) dt.26-06-2015 case has been lodged.
Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Tajpur Waini P.S. Case No. 352 of 2014, pending in the court of learned Judicial Magistrate, Ist Class, Samastipur.
With the above observation this application is disposed of.
