Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence robbery is against unknown. Name of the petitioner surfaced during investigation in the confessional statement of co-accused Mukesh Kumar Sah. Thereafter from the house of the petitioner, a motorcycle was seized which the petitioner claims to be of his brother-in-law (Sala). Petitioner is in custody since 26.03.2018. Investigation of the case is already complete. Petitioner has stated on oath that he has got no criminal antecedent.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.37126 of 2018 (2) dt.03-07-2018 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Saharsa Sadar Police Station Case No. 328 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
