In absence of the case diary, the present case is being taken up. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case registered under Sections 304B, 201/34 of the Indian Penal Code. Allegation against the petitioners is of committing torture and caused death of the victim due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.15578 of 2019(3) dt.11-04-2019 2/2 petitioners. The petitioners are in custody since 09-10-2018. Charge sheet has already been submitted. The petitioners have been falsely implicated in the present case. The petitioner Nos. 1 & 2 are cousin father-in-law and brother-in-law of the deceased respectively. They are separate in mess and property from husband of the deceased. They have no concern with the affairs of husband of the deceased.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri P.K. Mahtha, learned Judicial Magistrate-Ist Class, Jhanjharpur, DistrictMadhubani in connection with Andharamath P.S. Case No. 157 of 2018.
