The petitioner apprehends his arrest in Bhagwanpur Hatt P.S. Case No.13 of 2021 registered under Sections 30(a) and 41 (1) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the alleged poultry farm from where the recovery was made is jointly owned by the whole family and is closed since November, 2019, which is in abandoned condition. In support thereof, a supplementary affidavit has been filed. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his

No.26878 of 2021(4) dt.11-03-2022 2/2 arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Additional District & Sessions Judge II-cum-Special Judge, Excise, Siwan in connection with Bhagwanpur Hatt P.S.
