Petitioner is in custody in connection with Barauni P.S. Case No. 23 of 2017 for the offence under sections 406, 420 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that he was instrumental in fraudulently selling the Makka loaded in the truck. He submits that petitioner is owner and driver of the truck. He submits that allegation against the petitioner is patently false. On behalf of the complainant, learned counsel submits that petitioner is in habit of doing the same mischief and that is

Considering the totality of the facts situation and the fact that petitioner is in custody since 18.1.2018, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 23 of 2017 with further condition that petitioner will extend full cooperation in the conduct of the trial and in case he causes any delay in conduct of trial, the trial court is directed to take steps to ensure his attendance including cancellation of bail bond of the petitioner.
