The petitioner apprehends his arrest in connection with Saharghat P.S. Case no. 80 of 2016, registered under Sections 302 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that informant Moti Prasad Yadav received information on 26.10.2017 to the effect that his son Jawahar Kumar has been shot fire near Saharghat Police Station and he has been rushed to sadar hospital. Thereafter, informant along with other family members reached at Sadar Hospital and found his son dead sustaining fire arm injury. The people gathered there disclosed that one Sumitra Devi, wife of Anant Singh (Petitioner) had illicit relation and due to that reasons the people of her Myaka and Sasural had threatened to his son for dire consequences.

Learned counsel for the petitioner submits that after the

No.54177 of 2017 (2) dt.14-11-2017 2/2 death of his wife the re-marriage of the petitioner was performed with Sumitra Devi, sister of his wife, but she left the house and used to reside with Jawahar Kumar, son of the informant. Only on suspicion, the petitioner being the husband of Sumitra Devi has been implicated in this case. Moreover, in course of investigation the statement of Sumitra Devi was recorded in which she has stated about committing murder by her step son Gopal Kumar and brother Dharmbir Singh in her conspiracy due to avoiding to perform marriage by Jawahar Kumar with her.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Benipatti (Madhubani) in connection with Saharghat P.S. Case No. 80 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
