The petitioner apprehends his arrest in connection with Complaint Case No. 822 of 2017 registered for the offences punishable under Sections 323 and 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

By order dated 06.07.2020, notice has been issued to opposite party no.2 and notice has already served upon opposite party no.2 but nobody appears on behalf of opposite party no.2. Learned counsel for the petitioner submits that the petitioner is the husband of opposite party no.2. Allegation

Patna High Court CR. MISC. No.14770 of 2020(3) dt.16-03-2021 2/2 against the petitioner is false. He has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. In paragraph-12 of the bail petition, learned counsel for the petitioner has mentioned that the petitioner is still ready to keep her with full honour and dignity. Learned A.P.P. for the State has opposed the prayer for bail.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gaya in connection with Complaint Case No. 822 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
