The petitioner has filed this writ petition seeking a direction to the respondent No. 1/The Bihar Sanskrit Siksha Board to grant approval to the promotion of the petitioner on the post of Head Master of Lokmanya Sanskrit Uchcha Vidyalaya, Shahpur Sutihar, Saran which is a Non-Governmental Recognized Sanskrit High School on the resolution No. 03 dated 02.09.2023 (which is wrongly typed as 02.09.2013) sent by the Managing Committee of the School to the Bihar Sanskrit Siksha Board vide letter No. 12 dated 16.09.2023, for its approval.

3. Learned counsel for the petitioner contends that under the relevant recruitment rules, the Bihar Sanskrit Siksha

Patna High Court CWJC No.4901 of 2024(3) dt.12-09-2024 2/2 Board is required to approve the recommendation made by the Managing Committee of the school for appointment as a Head Master of the school.

4. No counter affidavit by the respondents have been filed.

5. Having regard to the nature of issue raised in the writ petition and the prayer made by the petitioner, this writ petition shall stand disposed of with a direction to the respondent No. 1/The Bihar Sanskrit Siksha Board to take a decision on the resolution No. 03 dated 02.09.2023 sent by the Managing Committee of the Lokmanya Sanskrit Uchcha Vidyalaya, Shahpur Sutihar, Saran to the Board vide letter No. 12 dated 16.09.2023, for appointment of the petitioner as Head Master of the aforesaid school, in accordance with law, within a period of four weeks from the date of receipt of the certified copy of the order.

6. The writ petition is disposed of with the above direction.
