The petitioner is seeking anticipatory bail in connection with Phulwaria P.S. Case No. 239/2018 registered under Sections 457, 380, 411/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the alleged theft articles and ornaments have been recovered from the box of Rita Kumari who was handed over to police and has already been granted bail. It is submitted that so far as allegation against this petitioner is concerned, he being the brother of said Rita Kumari is said to have objected when the informant wanted to catch hold of Rita Kumari. Save and except that there is no other allegation against him.

Learned A.P.P. for the State is present and has

Patna High Court CR. MISC. No.14902 of 2019(2) dt.12-03-2019 2/2 opposed the prayer for anticipatory bail of the petitioner. Considering the nature of allegations, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - XIII, Gopalganj, in connection with Phulwaria P.S. Case No. 239/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
