====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-07-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner, in the present case, is seeking anticipatory bail in connection with Atri P.S. Case No. 178/2019 registered for the offences under Sections 147, 149, 285, 283, 427, 353 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is a general and omnibus kind of allegation against 100-150 persons saying that they had indulged in blocking of road after death of five persons due to electric. Learned counsel submits that in First Information Report it is alleged against the petitioner that he was among the persons in the mob. Learned counsel further submits that petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.14368 of 2020(2) dt.14-07-2020 2/3 Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Having regard to the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that there is a general and omnibus kind of allegation against 100-150 persons saying that they had indulged in blocking of road after death of five persons due to electric current the First Information Report has been lodged against the petitioner that he was among the persons in the mob, petitioner has no criminal antecedent, let the petitioner above named in the event of his arrest or surrender within a period of four weeks from today in connection with Atri P.S. Case No. 178/2019 be released on bail on furnishing of bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XIII, Gaya, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e.

(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any

(iii) a condition that the person shall not leave India without the previous permission of the Court.
