The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 427, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in short is that while the officers were inspecting the land, the accused persons in their presence assaulted the informant due to which he received injury. It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.1.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Patna High Court CR. MISC. No.16124 of 2019(3) dt.07-05-2019 2/2 falsely been implicated in the present case. The injuries are on the non-vital part of the body. There is admitted land dispute between the parties. It is further submitted that the petitioner may be released after completion of eight months in custody. On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. The petitioner has got criminal case pending against them. Considering the aforesaid facts and circumstances, on completion of eight months in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 17/19.
