The petitioner seeks bail in Barh P.S. Case No.392 of 2016 registered under Sections 20 and 22 of N.D.P.S. Act. 43 kgs. of ganja is said to have been recovered from the house of the petitioner.

The learned counsel for the petitioner submits that prayer for bail of the petitioner was thrice rejected by this Court. Ultimately, this Court rejected the prayer for bail of the petitioner with an observation that the trial must be concluded within three months. Trial has not yet been concluded. It appears from perusal of the order itself that the prosecution case has already been closed and the statement of the accused has also been recorded. Therefore, the trial is at its fag end and only judgment is to be delivered after hearing the

In this view of the fact, I am not inclined to enlarge the petitioner on bail at the fag end of the trial. Accordingly, the same is rejected.

The trial court is directed to hear the arguments of both sides and dispose of the trial within one month from the date of receipt of this order.
