JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 18.05.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Although first information report was lodged after one day of the recovery of dead body of the deceased but in course of investigation, two eye-witnesses claimed to have seen the petitioners and others committing the alleged crime.

Therefore, I do not feel it proper to extend the privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Bihta P.S. case no. 421/2014 pending in the court of the Addl. Chief Judicial Magistrate, Danapur stands

Patna High Court Cr.Misc. No.7014 of 2015 (3) dt.18-05-2015 rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioners.
