Counter affidavit of the State has been filed wherein stand has been taken that in the provisional seniority list dated 29.9.2006 the petitioner on the basis of his appointment on 1.5.1984 as Forest Guard has been placed at serial No. 580. Specific stand of the respondents is that last person namely Panna Lal Rai who has been promoted as Forester is at serial No. 382 of the said provisional list. It is thus submitted that the petitioner is beyond zone of consideration and is not in a position to raise a grievance.

The writ petition is therefore dismissed for want of prosecution without going into the submissions made by the State.
