Petitioner apprehends arrest in connection with Benipatti P.S. Case No. 217 of 2021 registered for the offence punishable under sections 272, 273, 120B of the Indian Penal Code and Section 30(a), 41 of the Bihar Prohibition and Excise (Amendment) Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on the disclosure of apprehended accused persons namely Rajnish Singh and Rakesh Sahni. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized article.

No.15945 of 2023(2) dt.29-04-2023 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise, Madhubani in connection with Benipatti P.S. Case No. 217 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
