====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-03-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 504, 506, 307 and 379 of the Indian Penal Code and Sections 3, 4, 5 of the Prevention of Witch (Practices) Act.
3. As per the prosecution case, all the accused persons including this petitioner assaulted the informant and her family members by means of bricks and sword and called mother-inlaw of the informant Dayan. It is further alleged that they also committed theft of Rs. 1,50,000/- from the box kept in the house of informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Both parties are agnates and due to petty dispute, an altercation took

5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the backdrop of the case, nature of accusation and simple injury, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P. S. Case No. 244 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
